These Terms and Conditions (“Terms”) govern your access to and use of CareCompanion’s website, services, and related platforms within Sri Lanka.

By accessing our website, booking services, or using our services, you agree to be legally bound by these Terms. If you do not agree, you must refrain from using our services.

2. Company Information

CareCompanion is a Sri Lanka-based service provider offering non-medical personal assistance and medical escort support services.

CareCompanion does not provide medical diagnosis, treatment, nursing care, or emergency medical services unless expressly stated and legally licensed to do so.

3. Scope of Services

CareCompanion provides services including but not limited to:

  • Hospital visit assistance
  • Medical appointment escorting
  • Post-discharge non-medical support
  • Mobility assistance
  • Medication reminder support (non-clinical)
  • Companionship services
  • Administrative assistance related to healthcare visits

Important Clarification

CareCompanion:

  • Is not a hospital, clinic, or licensed medical institution
  • Does not replace professional medical care
  • Does not provide emergency medical response
  • Does not administer injections or invasive medical procedures unless legally permitted

Clients must seek qualified medical professionals for diagnosis and treatment.

4. Eligibility to Use Services

Services may be booked by:

  • Individuals over 18 years of age
  • Legal guardians acting on behalf of a client
  • Authorized family members

CareCompanion reserves the right to refuse service where:

  • Safety risks are identified
  • Required information is not disclosed
  • The service request exceeds our scope of operation

5. Bookings and Payments

5.1 Booking Confirmation

All bookings must be confirmed via:

  • Website
  • Telephone
  • Official WhatsApp or authorized communication channel

Bookings are confirmed only upon receipt of required payment.

5.2 Payment Terms

  • Advance payment may be required.
  • Prices are quoted in Sri Lankan Rupees (LKR).
  • Additional hours or extended services will be billed separately.
  • Transportation, waiting time, parking, or special requirements may incur additional charges.

CareCompanion reserves the right to revise pricing with notice.

6. Cancellation and Refund Policy

6.1 Client Cancellation

  • Cancellations made 24 hours prior may be eligible for refund or credit.
  • Cancellations within 24 hours may not be refundable.
  • No-shows are non-refundable.

6.2 Company Cancellation

If CareCompanion cancels due to operational reasons:

  • A full refund, or
  • Rescheduling option will be offered.

Refunds will be processed within a reasonable timeframe in accordance with Sri Lankan consumer protection practices.

7. Client Responsibilities

Clients must:

  • Provide accurate medical and personal information
  • Disclose mobility limitations, allergies, behavioral concerns
  • Ensure safe premises for service delivery
  • Arrange medical professionals where required

CareCompanion shall not be responsible for issues arising from incomplete or inaccurate information.

8. Health and Safety Disclaimer

CareCompanion staff are trained for non-medical assistance.

In the event of a medical emergency:

  • Emergency services (e.g., 1990 Suwa Seriya) will be contacted
  • CareCompanion is not liable for medical outcomes

Clients acknowledge that CareCompanion does not guarantee health improvements or medical results.

9. Limitation of Liability

To the fullest extent permitted under the laws of Sri Lanka:

CareCompanion shall not be liable for:

  • Medical complications
  • Hospital decisions
  • Delays caused by third parties
  • Force majeure events
  • Loss of personal belongings unless caused by proven negligence

Total liability, if applicable, shall not exceed the amount paid for the specific service in question.

10. Force Majeure

CareCompanion shall not be liable for failure or delay due to:

  • Natural disasters
  • Government restrictions
  • Civil unrest
  • Epidemics or pandemics
  • Transportation disruptions
  • Acts beyond reasonable control

11. Data Protection and Privacy

CareCompanion collects personal information in accordance with:

  • Sri Lanka Personal Data Protection Act No. 9 of 2022

We collect data for:

  • Booking management
  • Service delivery
  • Safety and communication

We do not sell personal data to third parties.

Medical or sensitive data is handled with strict confidentiality and security controls.

12. Intellectual Property

All website content including:

  • Logos
  • Branding
  • Text
  • Graphics

Are property of CareCompanion and may not be reproduced without written permission.

13. Code of Conduct

Clients and family members must:

  • Treat staff respectfully
  • Avoid abusive, threatening, or inappropriate behavior

CareCompanion reserves the right to terminate services immediately in cases of misconduct.

14. Indemnification

Clients agree to indemnify and hold harmless CareCompanion from claims arising from:

  • Misrepresentation of medical conditions
  • Failure to follow medical advice
  • Client negligence

15. Dispute Resolution

Any dispute arising shall first be resolved through:

  1. Good faith negotiation
  2. Mediation in Sri Lanka

If unresolved, disputes shall be subject to the jurisdiction of the competent courts of Sri Lanka.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.

17. Amendments

CareCompanion reserves the right to update these Terms at any time.

Updated Terms will be published on the website with the revised effective date.

Continued use of services constitutes acceptance of the updated Terms.
